Texas Bragg Trailers Warranty


MANUFACTURER WARRANTY

Texas Bragg guarantees our products to be free of defects for one (1) year from the date of initial purchase, to the

original purchaser, provided that he or she meets and complies with the following conditions.

NOTE: A trailer must be registered and registration properly submitted at time of purchase for any of the following coverages to be valid and or honored.

WARRANTY COVERAGE

For a period of three (3) years, the main frame is covered, and for a period of one (1) year, ramps, crossmembers, railings, and any non-wearable items are covered. Normal wear items are not covered by this warranty. These include but are not limited to: flooring (wood), paint, brake lining(s), bearings, and hoses.

All auxiliary parts, including, but not limited to: brake parts, jacks, wheels, bearings, tires, suspension parts, lights, hydraulic dump cylinders, and controls are covered by their individual manufacturer.

LIMITATIONS

Under this limited warranty, Texas Bragg is solely responsible for repairing or replacing any part/s that fail under the terms of this limited warranty, at its (Texas Bragg) factory, or at an authorized Texas Bragg dealer. Any other repair facilities must be approved in writing by Texas Bragg prior to the service.

Neither Texas Bragg or any of its licensed dealers are liable for any other obligation or liability, including incidental or consequential damages or contingent liabilities that may result from a failure of any parts to function properly. If applicable state law does not specifically provide otherwise, all other types of damages are excluded. Including, but not limited to: those resulting from loss of use, inconvenience, time lost, commercial loss or any other type of damages, whether foreseen or unforeseen.

In the event that a claimant needs to adjust or repair a Texas Bragg trailer, Texas Bragg will not reimburse the claimant without prior written approval from Texas Bragg. The labor costs for any repairs performed at another location other than Texas Bragg will be reimbursed at a rate of $45 per hour.

The trailer owner is responsible for all transportation costs associated with bringing the trailer to and from a dealer, a repair facility, or a Texas Bragg’s factory. Texas Bragg is not liable for any such costs incurred by the trailer owner.

DISCLAIMERS

All other warranties and representations are expressly excluded from this warranty. There is no implied or expressed warranty on the part of Texas Bragg as to whether or not Texas Bragg products are merchantable, fit for a particular purpose, or any other matter with respect to Texas Bragg. Texas Bragg does not authorize anyone, including an authorized dealer, to make any further or additional warranties on behalf of Texas Bragg.

DEALER RESPONSIBILITIES

In the event that you wish to make a claim under this Limited Warranty, it is the responsibility of the dealer to submit the claim directly to the manufacturer.

WARRANTY CLAIM PROCEDURE

It is recommended that you bring your Texas Bragg trailer to your Texas Bragg dealer within five (5) days of discovering a problem with your trailer so that it can be inspected.

In the event your local dealer is unable to fix the problem free of charge and you wish to make a claim under this warranty, your local dealer is required to submit a warranty claim form, along with all the necessary information, to Texas Bragg by registered letter or e-mail within ten (10) days after your defect is discovered.

A claim will be responded to by Texas Bragg by registered letter or e-mail sent to the dealer and to the claimant within thirty (30) days of receipt of the claim.

In order for Texas Bragg to be eligible to replace or reimburse the claimant under this limited warranty, the claimant must send any defective parts by prepaid freight to Texas Bragg. It is important for Texas Bragg to receive any defective parts within thirty (30) days of being approved if you wish to receive reimbursement.

As a result of this Limited Warranty, Texas Bragg reserves the right to not pay unreasonable costs to replace or repair any defects in a Texas Bragg trailer, and they (Texas Bragg) may, at their discretion, decide how much reimbursement or parts should be paid for any authorized work that has been conducted under its terms.

Upon receiving warranty approval, it may be necessary to submit pictures of the defective part(s), or the actual part(s), in order for payment to be processed prior to or during the warranty period.

Texas Bragg DOES NOT MAKE ANY OTHER EXPRESS OR IMPLIED WARRANTIES AND THERE ARE NO OTHER WARRANTIES THAT EXTEND ABOVE AND BEYOND THE WARRANTIES DESCRIBED ABOVE OR THAT EXTEND BEYOND THE TERMS OF THIS WARRANTY AGREEMENT.
